Terms and Conditions

1. General

These General Terms and Conditions apply exclusively to legal transactions between Miki Burgers and the respective pizza delivery service for the corresponding delivery area (hereinafter "Miki Burgers"), as well as their customers within the framework of order placement via the website mikiburgers.ch. The services offered by Miki Burgers through the mikiburgers.ch online ordering service are provided exclusively in accordance with these General Terms and Conditions (hereinafter "GTC").

By placing an order, the customer confirms that they have read, understood, and accepted the GTC without reservation.

Miki Burgers reserves the right to change the GTC at any time. The version of the GTC published on mikiburgers.ch at the time of ordering shall be authoritative.

2. Business Activity and Content of the mikiburgers.ch Online Ordering Service

The mikiburgers.ch online ordering service allows for the ordering of food and drinks available at Miki Burgers online. This service is exclusively available for deliveries in Switzerland.

The mikiburgers.ch online ordering service represents the assortment of Miki Burgers as an additional distribution channel. It is possible that the assortment on mikiburgers.ch may differ from that on other ordering channels of Miki Burgers. Restrictions of the online ordering service are reserved.

3. Ordering and Delivery

Orders are placed by the customer online on the website mikiburgers.ch. By placing the order, the customer makes a binding and final offer to purchase the selected products under the specified conditions within the ordering process. Acceptance of the order is usually confirmed by Miki Burgers via email. Miki Burgers reserves the right to refuse delivery without stating reasons. Resale of the products is permitted exclusively in own stores; resale is generally prohibited.

The minimum order value specified on mikiburgers.ch for the respective delivery area is binding. If this value is not reached by the ordered products, a surcharge will automatically be calculated to compensate for the difference between the order value and the minimum order value.

For delivery by the delivery service, the customer's address and telephone number, as well as the order, are recorded. The delivery address must be in Switzerland. All deliveries are made to the address provided by the customer.

Miki Burgers endeavors to adhere to the specified delivery times. However, these are non-binding target times for which Miki Burgers assumes no liability for non-compliance. Delayed deliveries generally do not entitle the customer to cancel the order or to partial or full refund of the purchase price.

If an order cannot be executed or can only be executed with difficulty for reasons not attributable to Miki Burgers (e.g., incorrect delivery address, customer absence, etc.), Miki Burgers may be released from the obligation to deliver unless the customer promptly provides supplementary information. The customer has no entitlement to re-delivery or compensation.

Due to the short delivery deadlines and the perishability of the products, orders cannot be changed or canceled, and delivered products cannot be taken back or exchanged.

4. Prices and Payment

The prices specified on mikiburgers.ch or in the online shop at the time of ordering are binding. Prices are in Swiss Francs and include delivery costs and value-added tax.

Payment is made by the customer by debit card, credit card, or Twint on mikiburgers.ch, or cash on delivery. Payment by invoice is only possible by prior agreement.

5. Youth Protection

The sale of alcoholic beverages is only permitted to persons aged 16 or over for beer, wine, and cider, and aged 18 or over for spirits, aperitifs, and alcopops. By ordering on mikiburgers.ch, the customer confirms to be at least 16 or 18 years old and thus authorized to purchase alcoholic beverages.

When delivering alcoholic products, Miki Burgers may require proof of identity. If the customer cannot adequately identify themselves or prove the minimum age, Miki Burgers reserves the right to refuse delivery of such products and to cancel this part of the order. Any claims by the customer in this regard are excluded.

6. Customer's Duty of Care

The customer undertakes to provide truthful, accurate, current, and complete information about themselves and the delivery address in the order form. Miki Burgers assumes no liability for losses or damages resulting from non-compliance with these obligations.

Miki Burgers reserves the right to verify the information and to exclude persons who violate the GTC from the online ordering service.

7. Availability and Changes to the mikiburgers.ch Website

Although Miki Burgers strives to ensure the highest possible availability of the mikiburgers.ch website and the mikiburgers.ch online ordering service, availability cannot be guaranteed.

Miki Burgers reserves the right to temporarily or permanently change, interrupt, or terminate the mikiburgers.ch online ordering service, with or without notifying the customer. Miki Burgers shall not be liable for such changes, interruptions, or terminations.

8. Links

The mikiburgers.ch website may contain links to other external websites or sources. Miki Burgers has no control over the availability or content of such websites or sources and therefore assumes no responsibility for their content.

9. Warranty and Liability

The customer expressly agrees that the use of the mikiburgers.ch online ordering service is at their own risk. Miki Burgers may use ingredients and additives that may cause allergies or intolerances. Customers with food allergies are advised to contact Miki Burgers by telephone before placing an order to inquire about current allergens.

Miki Burgers shall not be liable for force majeure, such as the failure of telephone lines or internet connections, labor disputes, governmental measures, unforeseeable failures of transport or energy, pandemics, or other unavoidable events. This also applies if such events occur with a vicarious agent of Miki Burgers.

Miki Burgers generally does not accept liability for delayed or faulty deliveries.

10. Data Protection

Miki Burgers informs the customer that personal data is collected and processed as part of contract fulfillment and for marketing purposes. By accepting these GTC, the customer agrees to the processing of their data by Miki Burgers. The processing of personal data is subject to the provisions of the privacy policy.

11. Applicable Law and Jurisdiction

This contract is subject to Swiss law. Disputes shall be exclusively decided by Swiss courts.
